Hi - I'm thinking of a divorce with my husband b/c he is putting his gambling addiction before his family needs.  I'm fed up with him maxing out his credit card and bank debt on something that wasteful and selfish.  We really can't afford this kind of behavior when we have to be frugal on food and clothing, then he goes and loses over 100k of money in risky gambling.  We have two young children under 5years old and I'm a stay at home mom.  I have my own bank account with money i've saved from before and during our marriage.  It is quit a bit of money.  I also have a rental property that I own.  He threaten to take half of everything and a rental property if I file for divorce.  Is there anything I can do to prevent that from happening?  Can I put the property in a trust?  What about money in the bank that belongs to me.  I don't want to give him a penny.  He would only gamble it away.  What will happen to the the children?  Is it possible that he can request alimony from me if I do not take the kids?  What happens if I just pick up and leave, then file for divorce.  He has his parents to help him with the kids if needed.  Thank you for any advice.

Money that you earned before the marriage is separate property. He will not get any of that. Money earned during the marriage is marital property, subject to equitable distribution. If you are able to show that he is a compulsive gambler who has placed your family in financial peril, there is little chance that a court will award him a significant share of your savings.

If you are able to prove in court your allegations of his gambling, it is unlikely that you will lose custody of your chilren. They will live with you, and he will pay you child support. You may also be awarded some of his property, a share of a pension, a 401(k) account or IRA.
